Chilwin Cheng Speaks on Lawyered Podcast

I recently appeared on Lawyered the Podcast, hosted by Husein Panju.

I enjoyed our wide-ranging conversation on white collar defense work, both criminal and regulatory.

In particular, we discussed the evolving law around secondary liability, where directors and officers can be held liable for corporate offenses if they fail to prevent them. Recent cases are further defining the mens rea (mental element) required for such liability. 

We also explored the recent Supreme Court of Canada ruling that police need warrants to access individuals' IP addresses, and what this may mean for the reasonable expectation of privacy in virtual spaces.

We had a chance to dig into some legal practice topics, including how the nature of white-collar criminal defense work is evolving in a world where many financial crimes are virtual and therefore more complex and resource intensive to prosecute or defend.
